The Story That Crossed an Ocean
A British regulator just tried to tell Americans what they can and can’t say online.
Ofcom, the United Kingdom’s powerful media and communications watchdog, has begun issuing legal notices to U.S. platforms such as 4chan, Kiwi Farms, and several others under the sweeping new Online Safety Act, a law critics call
“the most aggressive attempt at global internet censorship yet.”
But this time, the globalists ran straight into a wall called the First Amendment.
Attorney Preston Byrn, representing multiple American companies, has filed a federal lawsuit in Washington, D.C. accusing Ofcom of extraterritorial censorship, the act of applying foreign speech laws to American soil.
“All of their operations are American. All of their infrastructure is American. And they have no connection to the UK whatsoever,”
Byrne said.
“Yet Ofcom is threatening penalties as though it rules the internet.”

The Law That Forgot Geography
Ofcom’s legal notice demanded compliance from these U.S.-based platforms under threat of a £20,000 fine plus £100 per day in continuing penalties.
It’s an unprecedented claim of authority over foreign citizens.
When challenged, Ofcom doubled down in writing:
“The First Amendment binds only the US government and not overseas bodies such as Ofcom.”
That single line exposes a stunning contradiction.
If Ofcom stands outside U.S. law, then its orders have no standing within U.S. jurisdiction.
The same principle that prevents the American government from censoring speech also prevents foreign governments from pretending they can.

When Jurisdiction Becomes Imperialism
To understand the scale of Ofcom’s overreach, consider this: the regulator argues that it can govern any website with “links to the UK,” including those where British citizens simply visit or post content.
For example, 4chan was targeted because 7% of its users are from the UK.
By that logic, every global platform, from Rumble to X to gaysfortrump.org/, could be declared subject to British censorship merely because someone from London clicked a link. (Editor’s Note: They can Bugger OFF)
That’s not regulation. That’s digital imperialism.
It’s as if King George III picked up a modem and decided the Boston Tea Party was now a “safety violation.”

Sidestepping the Law: The MLAT End-Run
Under normal circumstances, when a government wants to gather evidence or enforce a judgment abroad, it must do so through the Mutual Legal Assistance Treaty (MLAT) between nations.
Ofcom chose to ignore that entirely.
By sending enforcement emails directly to U.S. entities, it bypassed the State Department, the Justice Department, and the court system, treating American companies like British subsidiaries instead of independent businesses.
The lawsuit calls this a “coercive extraterritorial action” and argues that Ofcom’s tactics violate both international law and U.S. sovereignty.

What the UK Calls Safety, the U.S. Calls Speech
The Online Safety Act, passed in 2023, empowers Ofcom to compel online platforms to remove “harmful” or “illegal” content, including speech that is legal in the United States.
This covers everything from “hate speech” and “misinformation” to undefined “psychological harm.”
It’s a regulatory mirror of the EU’s Digital Services Act and Canada’s Online Harms Bill, each weaponizing safety language to enforce speech conformity.
In essence, they are trying to create a global speech code, where local free speech protections become irrelevant once you log on.

The U.S. Response: Drawing a Digital Red Line
Byrne’s lawsuit isn’t just legal resistance. It’s a signal that America won’t surrender its constitutional protections to foreign authorities.
He has briefed members of Congress, and multiple senators are considering legislation to ban the enforcement of foreign censorship laws on U.S. soil.
He’s also drafting a New Hampshire state law imposing $1 million penalties per occurrence on any foreign body that attempts to apply foreign speech regulations to American citizens or platforms.
It’s an idea whose time has come: the Digital Sovereignty Act, the 21st-century firewall against global censorship.
